La relació contractual entre el propietari d’un terreny agrícola i un treballador del camp

Abstract

[cat] En el següent projecte s’investiga la relació contractual entre el propietari d’una finca agrícola i el treballador que s’encarrega d’explotar-la. Per portar a terme aquesta investigació s’ha entrevistat a un pagès que fa feina a les terres d’una família que presenta un títol nobiliari. Per una banda, el camperol és la persona que dirigeix l’activitat i el que presenta els coneixements i la formació. Per altra banda, els senyors són els que posseeixen les instal·lacions i les terres. L’activitat del treballador agrari es centra en l’elaboració de formatge, en el cultiu, manteniment de la granja i en la comercialització de la producció. El contracte és de tipus indefinit i s’especifica que el pagès ha de realitzar un pagament inicial (estim) i un pagament mensual fix al propietari. Per debatre si és efectiu el pagament mensual, s’exposa un exercici numèric a on es comparen dos mètodes: un pagament fix o un percentatge sobre els ingressos. En definitiva, una vegada s’ha analitzat l’activitat i la relació contractual s’arriba a la conclusió que el pagament fix ajuda a incentivar i motivar al pagès perquè realitzi el màxim esforç per aconseguir elevats beneficis.

[eng] In the following project investigates the contractual relationship between the owner of an agricultural property and the worker who is in charge of exploiting it. To carry out this research has been interviewed on a farmer who makes work on the lands of a family that has a title. In the case studied, the peasant is the person who runs the activity and which has the knowledge. Instead, the Lords are the ones who possess the facilities and lands. The agricultural worker's activity is focused on the production of cheese, in the cultivation, maintenance of the farm and in the commercialization of the production. The contract is of indefinite type and specified that the farmer must make a down payment and a fixed monthly payment to the owner. To discuss if the monthly payment is effective, is exposed a numerical exercise where they compare two methods: a fixed payment or a payment of a percentage of revenue. In short, once the activity has been analysed and the contractual relationship you come to the conclusion that the fixed payment helps to encourage and motivate the farmer so that the maximum effort to achieve high profits.
