[spa] El contexto penitenciario constituye una comunidad y/o grupo social sustancialmente
olvidado, aunque también estigmatizado, no sólo a nivel social, sino sobre todo, a nivel
político. Si bien se conoce la existencia del artículo 25.2 de la Constitución Española
actual, su aplicación es meramente parcial, relegando las intervenciones reeducativas
y/o resocializadoras a un plano secundario y adicional, siendo el Tercer Sector Social el
mayor responsable en dicha temática. A su vez, son múltiples los efectos que de estar
encerrado se sufren, se derivan; viéndose el interno afectado por un claro proceso de
desadaptación social que condicionará, indudablemente, su proceso
cognitivo-conductual basal para el resto de su existencia. Dicho lo anterior, el presente
documento pretende poner de manifiesto la superficial aplicación del artículo
constitucional mencionado, y ello, por medio de la realización de una investigación,
primero bibliográfica, después empírico-cualitativa, a través de la realización de
entrevistas semiestructuradas a informantes clave. De dicho proceso de investigación se
extrae la necesidad institucional y política de invertir una mayor cantidad de recursos en
lo tratamental, y en detrimento de lo regimental, siendo la reeducación el primero y más
relevante de los objetivos penitenciarios.
[eng] The prison context constitutes a community and/or social group that is substantially
forgotten, although it is also stigmatized, not only at the social level, but above all, at
the political level. Even if the existence of article 25.2 of the current Spanish
Constitution is known, its application is merely partial, relegating re-educational and/or
re-socializing interventions to a secondary and additional level, with the third social
sector being the most responsible in this area. At the same time, the effects of being
locked up are multiple; the inmate being affected by a clear process of social
maladjustment that will undoubtedly condition his basal cognitive-behavioral process
for the rest of his existence. Having said this, the present document aims to manifest the
superficial application of the aforementioned constitutional article, by means of an
investigation, first bibliographical, then empirical-qualitative, through semi-structured
interviews with key informants. From this research process is extracted the institutional
and political need to invest a greater amount of resources in the treatment realm, to the
detriment of the regimental area, being re-education the first and most relevant of the
penitentiary objectives.
