Delito de ocupación pacífica de inmuebles

[spa] Con la prumulgación del Código Penal de 1995, se tipifican una serie de conductas típicas con respecto a la ocupación, y que aparecen recogidas en el artículo 245.1 del CP, en el párrafo primero, se refiere a la ocupación y usurpación del inmueble con violencia o intimidación y a la usurpación de un derecho real. Este hecho, no hace sino requerir la apropiación de la cosa y la desposesión del inmueble o derecho real. Mientras que, en el segundo párrafo, se hace referencia a la segunda conducta de usurpación, en esta ocasión la ocupación pacifica de los bienes inmuebles, mostrándose como un tipo atenuado en el delito de usurpación en el que no hay cabida a la violencia ni intimidación. Sobre este último precepto referente a la “ocupación pacífica de bienes inmuebles” versa el presente trabajo, buscando conocer cuál es la respuesta punitiva al “movimiento okupa”, hecho que permite la tutela del bien jurídico como es la posesión y el derecho de uso sobre el patrimonio mobiliario. De este modo, se podrá entender que, la ocupación pacifica, debe desplegarse sin violencia ni intimidación. También se precisan los sujetos activos de la conducta, a saber cualquier persona salvo los propietarios o titulares del derecho real y pasivos, cualquiera con disposición sobre el inmueble. En definitiva se realiza una aproximación al delito de “Ocupación pacifica de inmuebles”, con el fin de realizar una reflexión en torno a la misma y en el seno del movimiento “okupa”.

[eng] With the enactment of the Criminal Code of 1995, a series of typical behaviors with respect to occupation are typified, and which appear included in article 245.1 of the CP, in the first paragraph, it refers to the occupation and usurpation of the property with violence or intimidation and the usurpation of a real right. This fact only requires the appropriation of the thing and the dispossession of the property or real right. While, in the second paragraph, reference is made to the second conduct of usurpation, on this occasion the peaceful occupation of real estate, showing itself as an attenuated type in the crime of usurpation in which there is no room for violence or intimidation. This last precept regarding the "peaceful occupation of real estate" is the subject of the present work, seeking to know what is the punitive response to the "squatter movement", a fact that allows the protection of the legal asset such as possession and the right of use over movable heritage. In this way, it can be understood that the peaceful occupation must be deployed without violence or intimidation. The active subjects of the conduct are also specified, namely any person except the owners or holders of real rights and liabilities, anyone with a disposition on the property. In short, an approach is made to the crime of "Peaceful occupation of buildings", in order to reflect on it and within the "squatter" movement.
