[spa] Los Ingresos y la tributación de los deportistas profesionales son algunos de los
temas más importantes para analizar en la Economía del Deporte. El aumento
de los ingresos de las grandes ligas y los abundantes salarios de las grandes
estrellas hace que el deporte profesional esté bajo la continua inspección de
periodistas y agencias tributarias. El vacío legal o la falta de claridad de
algunas leyes en distintos países dan rienda suelta a la utilización de la
ingeniería fiscal.
En este trabajo analizamos datos de los deportes con mayores ingresos en
diferentes países y la legislación de estos, respecto al pago de tributos de los
deportistas profesionales. En general la tributación en los diferentes países
analizados es semejante, la gran diferencia está en el tratamiento fiscal de los
derechos de imagen. Para evitar grandes diferencias en los tipos impositivos
entre países que derivan en mayor o menor competitividad se debería eliminar
el incentivo fiscal que tienen los derechos de imagen, es decir, la posibilidad de
declarar los derechos de imagen mediante el impuesto de sociedades. Las
rentas del deportista obtenidas de su relación laboral y los derechos de imagen
deben tributar en su totalidad por IRPF.
[eng] Income and taxation of professional athletes are some of the most important
topics to analyze in the Economy of Sport. The income increase of the big
leagues and the large salaries of the big stars drive the professional sport under
the continuous inspection of journalists and tax agencies. The legal vacuum or
the lack of clarity of some laws in different countries gives free rein to the use of
fiscal engineering.
In this paper we analyze data on sports with higher income in different countries
and their legislation, regarding the payment of taxes of professional athletes. In
general, taxation in the different countries analyzed is similar; the great
difference is in the tax treatment of image rights. To avoid large differences in
tax rates between countries that result in greater or less competitiveness should
eliminate the tax incentive that have the rights of image, that is to say, the
possibility of declaring the rights of image through corporate tax. The income of
the athlete obtained from their employment relationship and image rights must
be taxed in full by income tax.
