[cat] La subrogació de la gestació és una pràctica que s’ha anat popularitzant durant les darreres tres dècades, i la qüestió sobre la seva possible regulació ha suscitat nombroses discussions des de l’ètica, les ciències de la salut, el dret i la filosofia. El propòsit d’aquest treball és el d’aprofitar totes aquestes discussions per posar de manifest les limitacions conceptuals dels fonaments filosòfics dels drets de propietat i de la construcció de l’individu modern. En darrer lloc es defensa una postura abolicionista en virtut del que creiem que hauria de ser la norma en tota qüestió legal: la subordinació del mercat a l’esperit de la llei i no a l’inrevés.

[eng] Gestational surrogacy is a practice that has been increasingly popularized over the past three decades, and the question about its possible regulation has brought several debates from ethics, health sciences, jurisprudence and philosophy. The purpose of this project is to take advantage of all these debates to show the limitations of the philosophical foundations of property rights and the modern individual. Finally, an abolitionist position is defended by virtue of what we think it should be the rule in every single legal question: the market’s subordination to the spirit of the law and not the other way around.
