Medicina personalizada en España: Legislación

Abstract

[spa] La medicina del siglo XXI ha evolucionado hacia una medicina más personalizada, predictiva, preventiva y participativa. Para poder llevar a cabo este tipo de medicina es necesario recoger gran cantidad de información, mucha de ella de carácter sensible, relacionada con el ámbito más íntimo de las personas. Esa información puede ser objeto de serios problemas éticos, sociales y legales, precisándose, entre otros, de un marco normativo que la regule. Este trabajo tiene como objeto contextualizar esta medicina personalizada de precisión y dar a conocer la legislación vigente que tiene como fin proteger los derechos que pudieran verse lesionados con esta línea de atención sanitaria a nivel español y secundariamente con la legislación europea desde un punto de vista genérico.

[eng] The medicine of the 21st century has evolved towards a more personalized, predictive, preventive and participative medicine. To be able to carry out this type of medicine it is necessary to collect a great quantity of information, some of sensitive nature, related to the most intimate area of the people. This information can be the object of serious ethical, social and legal problems, requiring, among others, a regulatory framework that regulates it. The objective of this work is to contextualize this personalized medicine of precision and to make known the current legislation that aims to protect the rights that could be injured with this line of health care in Spain and secondarily with European legislation from a generic point of view.
