Conflictos de competencia en la Unión Europea: Irlanda y su ayuda estatal ilegal al grupo Apple por medio del Impuesto sobre Sociedades

[spa] La Comisión Europea acusa a Irlanda de ofrecer ayudas ilegales a Apple a través de beneficios fiscales en su Impuesto sobre Sociedades, lo que permite a la entidad obtener un trato preferencial frente a sus competidores. Tras una contextualización del problema dentro de la evolución normativa europea que regula la libre competencia en la UE y a partir del caso Apple, se analizará las ayudas estatales ilegales apuntando posibles soluciones.

[eng] The European Commission accuses Ireland of offering illegal aid to Apple by lowering its Corporate Tax which allows the company to obtain a preferential treatment against its competitors. After a brief contextualization of the problem within the evolution of the European regulation that rules the free competition in the EU and drawing on the Apple case, this paper analyzes illegal state aids pointing at possible solutions.
