Justicia comparativa y democracia en La Idea de la Justicia de Amartya Sen

Abstract

[spa] Cuando pensamos en una teoría de la justicia tendemos a relacionarla con un conjunto de principios e instituciones acordes a un ideal de justicia. Esta tendencia, pese a haber sido la opción predominante a lo largo de la historia de la filosofía política, puede no ser la manera más eficiente de perseguir una sociedad más justa. En este trabajo se analiza una teoría de la justicia alternativa, la propuesta por Amartya Sen en su obra La Idea de la Justicia. En esta encontramos un claro contraste entre el enfoque trascendental –centrado en la justicia perfecta y sus instituciones– y el enfoque comparativo –más orientado a combatir las injusticias a través del análisis de las realizaciones sociales. Durante el desarrollo del trabajo se exponen las razones por las cuales Sen considera necesario un cambio de rumbo en las teorías de la justicia; entre ellas se destaca el papel central de un razonamiento público, objetivo, plural e imparcial que permita establecer un vínculo entre la democracia –entendida como gobierno por discusión– y la idea misma de justicia.

[eng] When we think about a theory of justice, we tend to relate it to a set of principles and institutions in accordance with an ideal of Justice. This trend, despite being the common choice throughout the history of political philosophy, may not be the most efficient way to pursue a more just society. This paper analyses an alternative theory of Justice, proposed by Amartya Sen in his work The Idea of Justice. In this work we find a clear contrast between the transcendental approach –focused on finding the perfect justice and its institutions– and the comparative approach –more oriented to combat injustices through the analysis of social achievements. During the development of our work are presented the reasons why Sen considers necessary a change of course in matter of theory of justice; among them is highlighted the central role of an objective, plural and impartial public reasoning able to establish a link between democracy –understood as government by discussion– and the idea itself of justice.
