El derecho a la desconexión digital del trabajador

[spa] La incorporación de las nuevas tecnologías en el ámbito laboral ha provocado la aparición de nuevas formas de organización del trabajo. La facilidad con la que podemos estar conectados mediante los dispositivos digitales en cualquier momento y lugar ha propiciado la prolongación de la jornada laboral más allá de lo legal o convencionalmente establecido, diluyéndose las fronteras que separan el tiempo de trabajo y el tiempo de descanso. La preocupación que la hiperconectividad digital ha suscitado, ha llevado a diferentes países, entre ellos España, a regular el derecho a la desconexión digital. En el presente trabajo voy a analizar régimen jurídico de la desconexión digital en España.

[eng] The incorporation of new technologies in the workplace has led to the emergence of new forms of work organisation. The ease with which we can be connected via digital devices at any time and place has led to the extension of the working day beyond what is legally or conventionally established, blurring the boundaries that separate work time and rest time. The concern that digital hyperconnectivity has raised has led different countries, including Spain, to regulate the right to digital disconnection. In this paper I will analyse the legal regime of digital disconnection in Spain.
