Incumplimientos en el contrato de hospedaje y su interpretación en la jurisprudencia

[esp] El tema de este trabajo de fin de grado se centra en el estudio del contrato de hospedaje, a partir de la Ley de Turismo de las Islas Baleares, y las consecuencias que pueden causar el incumplimiento de las obligaciones incluidas en el mismo, poniendo de ejemplo sentencias que se han llevado a cabo en España. El principal objetivo es dar a conocer las peculiaridades que destacan en el contrato de alojamiento. Para ello, se explicará en primer lugar su naturaleza jurídica, las principales características, las fases que tienen lugar en la creación y extinción del contrato, los sujetos que participan en esta relación contractual y los derechos y obligaciones que se crean. En segundo lugar, se explicará qué son los incumplimientos contractuales y extracontractuales, y a continuación, se expondrán ejemplos a partir del estudio de sentencias en base a la interpretación de la jurisprudencia de nuestro país. Por último se realizará una conclusión general del trabajo.

[eng] The subject of this thesis is focused on the study of the accommodation contract, based on the Tourism Law of the Balearic Islands, and the consequences that can be caused by the breach of the obligations that are included in this contract, using as an example sentences carried out in Spain. The main objective will be to explain the peculiarities that stand out in the accommodation contract. To this end, firstly, the legal nature, the main characteristics, the phases that take place in the creation and termination of the contract, the parties involved in this contractual relationship and the rights and obligations that are created will be explained. Secondly, what contractual and extracontractual breaches are will be explained and then, an analysis of the main breaches will be done through sentences based on the interpretation in the jurisprudence of our country. Finally, a general conclusion of the work will be made.
