[eng] The market of audio-visual rights of football in Spain joins the sport with the
business strategy of television and radio operators. A system where the audiovisual
rights are auctioned and where until now an only one purpose occupied
first place: The biggest possible viewers and football is one of the audio-visual
contents with more attraction power.
With dealing not equitable at all as for economic share-out for the audio-visual
rights between the teams of football, which is translated in big imbalances at
sports level, F.C. Barcelona and Real Madrid C.F., they are the big beneficiaries
of the current system of the audio-visual market.
In a context of economical crisis, this sector does not escape to its effect and if
we add the big payments that the acquisition of the rights demands it is
obtained as turned out numerous economic problems of the operators which do
not manage to promote such procurement. Only the big operators can face
these big payments what without place to doubt supposes a too much weighed
flagstone for the potentials rivals, therefore this market presents a quite
pronounced oligopoly structure.
With so high entry barriers, it is indispensable to act against this anti competitive
attitude and protect the interests of the consumers. On the other hand the last
resolution of the National Commission of the Competition (CNC), with nº
records S / 0006/07 of April 14, 2010, limits the duration of the contracts of
acquisition and development of the rights of football to three periods, like this
way the right of first refusal and extension of the same ones.
Thus the entry to new competitors is promoted because with a temporary limit
on the duration of the contracts, they exist incentives to the rival potentials to be
brought in on the market once conclude the above mentioned contracts.
Another competitive meaning before this resolution would be that of there
adapts itself to the so called effect network that presents the market, since only
there are had incentives to be brought in the sector if you can acquire the
maximum number audio-visual rights as possible, and contracts with a very high
duration, such incentives do not take place.
Due to the big losses of the companies that act on the market, the doubt about
the viability of the sector acquires a major importance and opens an options fan
to him to improve the above mentioned situation, which happens for promoting
TV Premium, TDT, streaming and mobile device as measurement of comeback
rights investment.
[spa] El mercado de derechos audiovisuales de fútbol en España, une al deporte rey
por excelencia y a la estrategia empresarial de las grandes operadoras de
televisión y radio. Un sistema en el que se subastan derechos audiovisuales y
en los que hasta ahora un único objetivo primaba: la mayor audiencia posible, y
el fútbol es uno de los contenidos audiovisuales con más poder de atracción.
Con un trato nada equitativo en lo que se refiere al reparto económico por los
derechos audiovisuales entre los equipos de fútbol, que se traduce en grandes
desequilibrios a nivel deportivo, F.C. Barcelona y Real Madrid C.F., son los
grandes beneficiarios del actual sistema del mercado audiovisual.
En un contexto de crisis económica, este sector no escapa a su efecto y si
sumamos los grandes desembolsos que exige la adquisición de los derechos
se obtiene como resultado numerosos problemas económicos de las
operadoras que no consiguen rentabilizar tales adquisiciones.
Sólo las grandes operadoras pueden hacer frente a estos grandes
desembolsos lo que sin lugar a duda supone una losa demasiado pesada para
los potenciales competidores, por lo que este mercado presenta una estructura
de oligopolio bastante marcada.
Con unas barreras de entrada tan elevadas, es indispensable actuar ante esta
actitud anti competitiva, y proteger los intereses de los consumidores. Por otro
lado la reciente resolución de la Comisión Nacional de la Competencia (CNC),
con nº expediente S/0006/07 de 14 abril de 2010, limita la duración de los
contratos de adquisición y explotación de los derechos de fútbol a tres
temporadas, como así el derecho de tanteo y retracto y prórroga de los
mismos.
De esta forma se promueve la entrada a nuevos competidores, ya que al
establecerse un límite temporal a la duración de los contratos, existen
incentivos a los potenciales competidores a entrar en el mercado una vez
concluyan dichos contratos.
Otro significado competitivo ante esta resolución sería la de amoldarse al
denominado efecto red que presenta el mercado, ya que sólo se tienen
incentivos a entrar en el sector si puedes adquirir el máximo número de
derechos audiovisuales posibles y con contratos con una duración muy
elevada, tales incentivos no se producen.
Debido a las grandes pérdidas de las empresas que actúan en el mercado, la
duda acerca de la viabilidad del sector adquiere una mayor importancia y se
abre un abanico de opciones para mejorar dicha situación, que pasa por
potenciar la televisión de pago, ya sea en formato digital, TDT, televisión por
internet o “streaming” y telefonía móvil, como medida de retorno de la inversión en derechos.
